Dealer Terms

These Dealer Terms apply to dealerships and their authorized users of TradeCapture Pro("TradeCapturePro", "we", or "us"). They supplement our Terms of Use and Privacy Policy. By using TradeCapturePro as a dealer, you accept these terms.

Authorized Account Use

You may use TradeCapturePro only for the dealership you are authorized to represent and only with customers you are legally permitted to contact. You are responsible for the accuracy of your dealership profile and identity.

Team & User Management

Dealer admins are responsible for inviting appropriate users, assigning appropriate roles, deactivating users when employment or authorization ends, protecting login credentials, and maintaining correct contact information. Do not leave former employees or unauthorized users with continued access.

Customer Contact Permissions

You are responsible for having the appropriate permission or legal basis to contact customers through TradeCapturePro, including by text and email. TradeCapturePro delivers the messages you initiate; it does not independently obtain customer consent on your behalf. You must:

• Use the service only with customers you are legally permitted to contact
• Provide accurate dealership identity in messages — no deceptive links or misleading sender names
• Not use TradeCapturePro for spam or unrelated advertising
• Respect customer communication preferences
• Comply with applicable SMS and email marketing laws

Trade Requests & Customer Data Handling

Customer trade information is collected at your request and is shared with your dealership. You are responsible for lawful use of customer information you collect through TradeCapturePro, including any retention or deletion obligations that apply to you.

Trade Database

Captured trade information remains within your authorized dealer account. It is not made available to competing dealerships. You are responsible for lawful use of customer information in your database. Opportunity matching occurs only within your authorized data. TradeCapturePro does not guarantee that a captured trade is still available; customer availability should be confirmed before relying on older records.

Appraisal Information & Internal Notes

Appraisal values, recon deductions, internal notes, and follow-up information are your dealership's working data. You remain responsible for your own appraisal and purchase decisions; TradeCapturePro does not guarantee that customer-submitted information is accurate.

Performance Analytics

Dealer analytics show operational data based on recorded events. Metrics may be affected by missing events, customer behavior, browser or session differences, test records, and data-entry quality. We do not guarantee business results from analytics.

Subscription & Payment Obligations

You are responsible for subscription fees for your account according to current pricing. Billing is recurring; a trial may apply; plans may be changed or canceled per the subscription terms; and payment failure may result in suspension. We do not store raw credit-card numbers; payment is handled by our payment provider.

Dealer Branding & Communication Templates

You may customize your logo, colors, sender name, and message templates. You must not use branding or templates in a way that misrepresents your dealership or impersonates another business.

Data Rights

Your dealership retains its rights in the dealership-specific customer and trade information it submits or collects through its authorized TradeCapturePro account. You grant us the rights necessary to host, store, process, display, analyze, transmit, secure, and back up that information to operate the service for you. We do not claim ownership of your dealer data beyond these operational rights. We may use aggregated or de-identified information for product improvement as described in the Privacy Policy.

Security Responsibilities

• Keep account credentials secure and limit access to authorized users
• Assign least-privilege roles (managers vs. salespeople)
• Promptly deactivate users who should no longer have access
• Do not share logins or attempt to access other dealerships' data

Acceptable Use & Termination

We may suspend or terminate dealer access for violations of these terms, unpaid accounts, abusive or fraudulent use, or to protect the service or other dealers. On cancellation, access is disabled per the subscription terms and data is retained per the Privacy Policy retention section to allow export and meet legal obligations.

Changes to These Terms

We may update these Dealer Terms from time to time. The effective date above reflects the current version. Continued use after a material change constitutes acceptance. Where material changes occur, we may support re-acceptance for new terms versions.

Governing Law

These terms are governed by the laws of the applicable jurisdiction in which TradeCapture Pro operates, as confirmed in our legal configuration.
